## 1. Legal Information
This document governs access to and use of the MyBasicCRM software and all associated services (the “Services”), owned by **MBCTECNO ONLINE SOLUTIONS SL**, with registered office at Eduard Ferrés 12, Vilassar de Mar, Barcelona, 08340, Spain (hereinafter “MyBasicCRM” or the “Company”).
MyBasicCRM is a technological platform offered under the **Software as a Service (SaaS)** model intended **exclusively for professional and business use (B2B)**. Use of the Services by consumers or end-users is strictly prohibited.

2. Acceptance of Terms
Accessing, registering for, or using the Services constitutes full and unconditional acceptance of these Terms of Use. If you do not agree, you must refrain from using the Services.
The user represents and warrants that they act on their own behalf or on behalf of a business or professional entity with the legal capacity to bind such entity.
3. Registration and Accounts
Access to the Services requires prior registration and account creation. The user agrees to provide truthful, current, and complete information.
The client is solely responsible for:
* Safeguarding and maintaining the confidentiality of their login credentials.
* All activities carried out through their account.
* Managing permissions granted to internal users.
MyBasicCRM is not responsible for unauthorized access resulting from negligent use of credentials.
4. Permitted Use and Prohibitions
The client agrees to use the Services in compliance with the law, good faith, public order, and these Terms.
It is expressly prohibited to:
* Use the Service for illegal or unauthorized purposes.
* Introduce malicious code, viruses, malware, or any element that may damage the platform.
* Copy, modify, resell, sublicense, reverse engineer, or exploit the software without express written authorization.
* Use the Services in a manner that abnormally exceeds reasonable usage parameters.
MyBasicCRM reserves the right to suspend or terminate accounts violating these obligations.
5. Customer Data and Liability
MyBasicCRM acts solely as a provider of technological infrastructure. **The client is exclusively responsible for all data and content entered into the platform**.
MyBasicCRM:
* Does not determine the purposes or means of processing client data.
* Has no obligation to know, review, or verify the content, accuracy, legality, confidentiality, or sensitivity of the data.
Access to data by MyBasicCRM will be strictly limited to what is technically necessary for service provision, maintenance, support, security, or legal compliance.
The client guarantees they have all necessary legal bases, consents, and authorizations for processing the data, including personal data, in accordance with Regulation (EU) 2016/679 (GDPR) and applicable law.
MyBasicCRM assumes no liability for claims, fines, damages, or losses arising from client data or its processing.
6. Payment and Billing
Services are subscription-based and require prepayment of applicable fees.
Fees:
* Are billed in advance.
* Are non-refundable.
* Do not include taxes, which are the client’s responsibility.
MyBasicCRM reserves the right to modify prices with prior notification.
7. Cancellation and Termination
The client may cancel their account using the mechanisms provided within the platform.
MyBasicCRM may suspend or terminate the Service immediately and without compensation in cases of:
* Breach of these Terms.
* Abusive or abnormal use of the Service.
* Legal or security requirements.
Upon cancellation, data may be deleted once made available to the client through the technical means defined by MyBasicCRM.
8. Service Availability
MyBasicCRM does not guarantee continuous availability or error-free operation. The Service is provided “as is” and “as available.”
9. Limitation of Liability
To the fullest extent permitted by law, MyBasicCRM’s total liability is limited, for all claims combined, to the amount actually paid by the client corresponding to **one (1) month of service**.
MyBasicCRM will not be liable for indirect damages, loss of profits, loss of data, business interruption, or other consequential damages.
10. Indemnification
The client agrees to indemnify and hold harmless MyBasicCRM against any claims, fines, damages, or costs arising from the use of the Service or the content of data entered.
11. Modification of Terms
MyBasicCRM may modify these Terms at any time. Continued use of the Services constitutes acceptance of such modifications.
12. Governing Law and Jurisdiction
These Terms are governed by **Spanish law**.
For any disputes arising from the use of the Services, the parties submit expressly to the **courts and tribunals of Barcelona**, waiving any other jurisdiction that may correspond.
